1. Our Services

LooksArt is a mobile application and website providing interactive quests and digital art discovery experiences (hereinafter – “Quests” or “Services”). Users engage with clues and narratives to explore art, culture, and creativity, either virtually or in physical locations. Our mission is to transform art and cultural experiences into engaging interactive stories.

2. Definitions

App or Mobile app: LooksArt mobile application, available via Google Play and the App Store.

Website: LooksArt website, available at www.looksart.eu
Quest: a digital, self-guided tour or interactive challenge that may include tasks, clues, and stories.
Clue: a text or multimedia element necessary for completing a Quest.

3. Legal Entity

LooksArt is a product owned and operated by LOOKSART SOCIETA’ A RESPONSABILITA’ LIMITATA SEMPLIFICATA (LOOKSART S.R.L.S.), a private limited liability company registered in Italy, headquartered at VIA VITTORIO SPINAZZOLA 38 – 00164 – ROMA (RM), Italy.

4. Applicability of Terms

Before using our mobile app or visiting our website, you must read these Terms of Use (“Terms”). By accessing or using our Services, you agree to comply with these Terms and all applicable laws. If you do not agree, please do not use our Services.

We may modify these Terms from time to time. Changes will be effective upon publication on the App/Website. If significant changes affect your rights, we will provide prior notice and give you the option to discontinue use.

We strive to ensure high quality and accuracy of all Quests. However, errors or omissions may occur. If you encounter an issue, please notify us via the feedback section in the App or by email at [support@looksart.com].

Content is provided for entertainment and cultural purposes. We do not guarantee that information in Quests is fully accurate, complete, or up to date.

7. Warranties

We provide the App and Website “as is” and “as available.” We do not warrant that:

the Services will be error-free or uninterrupted,
all Quests will meet your expectations,
or that errors will not occur.

We are committed to resolving issues promptly.

8. Liability

LooksArt provides access to Quests but is not responsible for risks associated with how you use them (including outdoor exploration).
To the maximum extent permitted by EU and Italian law, LooksArt shall not be liable for any damages, including indirect or consequential damages, resulting from use of our Services.
Nothing in these Terms excludes liability for death, personal injury, fraud, or other liability that cannot be excluded under Italian or EU law.

9. Proprietary Material & Intellectual Property

All text, graphics, designs, software, photographs, videos, typefaces, and other content (“Proprietary Material”) available on the App or Website are owned by LooksArt or licensed to us. This material is protected by copyright, trademark, and other intellectual property laws of Italy and the EU.

You may not copy, distribute, modify, or otherwise exploit Proprietary Material without our prior written permission.

All logos and trademarks of LooksArt are protected. Third-party trademarks are used only for identification purposes.

10. Copyright Policy

We respect intellectual property rights. If you believe your copyright has been infringed on our Services, please notify us at [support@looksart.com], including:

a description of the work claimed to be infringed,
proof of ownership,
and your contact details.

False claims may expose you to liability (including legal costs).

11. Consumer Rights

Purchases of Quests are digital content contracts under EU and Italian law.

By purchasing a Quest and beginning access/download, you expressly agree to waive your 14-day withdrawal right under the Consumer Rights Directive (2011/83/EU), as implemented in Italy.

This does not affect your statutory rights regarding defective or non-conforming digital content.

12. Compliance with EU Law (DSA & e-Commerce Directive)

LooksArt complies with:

EU Digital Services Act (Regulation (EU) 2022/2065): ensuring transparency, notice-and-takedown procedures, and user safety.

EU e-Commerce Directive (2000/31/EC): ensuring clear information, liability limitations, and safe hosting of third-party content.

13. Termination of Service

We may suspend or terminate your account or access to Services if you breach these Terms or applicable laws. You may stop using the Services at any time.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Italy and applicable EU law, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Rome, Italy.
