1. Our Services

LooksArt is a mobile app and website providing interactive tours and experiences that introduce art and culture (the “Tours” or the “Services”). Users solve clues and follow storylines while exploring art, culture and creativity — either virtually or in real places. Our mission is to turn cultural experiences into engaging interactive stories.

2. Definitions

App / mobile application: the LooksArt mobile app available on Google Play and the App Store.
Website: the LooksArt website at www.looksart.eu.
Tour: a digital self-guided tour or interactive experience that may include tasks, clues and stories.
Clue: a text or multimedia element needed to complete a Tour.

3. Legal entity

LooksArt is a product owned and operated by LOOKSART SOCIETA’ A RESPONSABILITA’ LIMITATA SEMPLIFICATA (LOOKSART S.R.L.S.), registered in Italy at VIA VITTORIO SPINAZZOLA 38 – 00164 – ROMA (RM), Italy.

4. Scope of the terms

Before using the app or the website you must read these Terms of Use (the “Terms”). By accessing or using the Services you agree to comply with these Terms and with applicable law. If you do not agree, please do not use our Services.

We may amend the Terms from time to time. Changes take effect once published on the Website or in the App. Where changes materially affect your rights, we will give you advance notice and the opportunity to stop using the Services.

5. Privacy and data protection

Your privacy matters to us. We process personal data in accordance with the General Data Protection Regulation (EU 2016/679) (the “GDPR”) and Italian data protection law. You can read more in our Privacy Policy.

6. Quality of information and disclaimer

We work to keep every Tour accurate and of a high standard. Even so, errors or inaccuracies are possible. If you come across a problem, please tell us through the feedback section in the app or by email at brand@looksart.eu.

The content is provided for entertainment and cultural purposes. We do not warrant that the information in the Tours is entirely accurate, complete or up to date.

7. Warranties

We provide the App and the Website “as is” and “as available”. We do not warrant that:

• the Services will run without errors or interruptions;
• every Tour will meet your expectations;
• no errors will occur.

We aim to resolve any problems promptly.

8. Liability

LooksArt provides access to the Tours but is not responsible for the risks involved in how you use them (including walking outdoors).
To the fullest extent permitted by EU and Italian law, LooksArt is not liable for any damage, including indirect damage, arising from the use of the Services.
Nothing in these Terms excludes liability for death, personal injury, fraud or any other liability that cannot be excluded under Italian or EU law.

9. Intellectual property

All text, graphics, design, software, photographs, video, fonts and other content (the “Materials”) on the Website and in the App belong to LooksArt or are licensed to us. They are protected by copyright, trade mark and other Italian and EU intellectual property laws.

You may not copy, distribute, modify or otherwise use the Materials without our prior written permission.

All LooksArt logos and trade marks are protected. Third-party trade marks are used for identification purposes only.

10. Copyright

We respect intellectual property rights. If you believe your copyright has been infringed within our Services, please tell us at brand@looksart.eu and include:

• a description of the work whose rights have been infringed;
• evidence that you own the rights;
• your contact details.

False claims may lead to liability (including legal costs).

11. Consumer rights

Purchases of Tours are digital content contracts under EU and Italian law.

By purchasing a Tour and beginning access to or download of it, you expressly agree to waive the 14-day right of withdrawal under the Consumer Rights Directive (2011/83/EU) as implemented in Italy.

This does not affect your statutory rights in respect of defective or non-conforming digital content.

12. Compliance with EU law (DSA and the E-Commerce Directive)

LooksArt complies with:

The EU Digital Services Act (Regulation (EU) 2022/2065): transparency, notice-and-takedown procedures and user safety.

The EU E-Commerce Directive (2000/31/EC): clear information, limitations of liability and safe hosting of third-party content.

13. Termination

We may suspend or terminate your access to the Services if you breach these Terms or applicable law. You may stop using the Services at any time.

14. Applicable law and jurisdiction

These Terms are governed by Italian law and applicable EU law, without regard to conflict-of-law rules. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of Rome, Italy.
